Privacy Notice pursuant to Art. 13 of EU Regulation 2016/679 – Consumer

This privacy notice is provided pursuant to Art. 13 of EU Regulation 2016/679 (hereinafter also “the Regulation”); according to the aforementioned law, such processing shall be based on the principles of correctness, lawfulness, transparency, and the protection of your privacy and your rights.

Therefore, F. Divella S.p.a., with registered office in Largo D. Divella, 1, 70018 Rutigliano (BA), in its capacity as Data Controller, hereby informs you that the processing of your data is carried out primarily using automated tools, adopting security measures designed to guarantee the protection and maximum confidentiality of the processed data. This processing is performed for the execution of obligations arising from the contract to which you are a party as the Data Subject, for administrative and accounting activities, credit checks, statistical activities, as well as for tax fulfillments based on obligations established by law or regulation. It will also be necessary to provide a contact detail (telephone or mobile number) to allow us to confirm the order and product delivery methods; the legal basis for processing is the management of the contract and the fulfillment of regulatory obligations. The provision of data is necessary, and it will be stored for the period required by the relevant legislation, and in any case for 10 years.

The data, which will not be disseminated, may be communicated to banking institutions for the management of obligations arising from the execution of the contract; to third-party companies that perform activities on behalf of the Data Controller that are related and instrumental to the management of the contract; to entities, consortia, or associations involved in assessing creditworthiness and payment behavior; and to subjects who are granted the right to access the data by provisions of law and/or secondary legislation.

Data will not be transferred outside the European Union.
Finally, we inform you that you may contact the Data Controller and exercise the rights provided for in Art. 12 of the Regulation by writing to divella@divella.it. You may, therefore, request to know the origin of the data as well as the logic and purposes of the processing; to obtain the erasure, transformation into anonymous form, or blocking of data processed in violation of the law, as well as the updating, rectification or, where interested, integration of the data; and to object, for legitimate reasons, to the processing. The right to withdraw consent at any time is guaranteed, without prejudice to the lawfulness of the processing based on the consent given before the withdrawal. The right to data portability and the right to lodge a complaint with a supervisory authority are guaranteed.
